Notice of special general meeting
A Special General Meeting will be held at Parkhurst Primary School on March 3, 2011 from 7.30pm to discuss and vote on the following:
A resolution in respect of dissolution of theParkhurst Village Residents Association (PVRA).
Information as to the intent and reasons for the dissolution.The PVRA has for many years served the interests of the residents of the Parkhurst Village.
The Association faces a High Court cost order of approximately R150 000 taken against it by Hollyberry Props 3 (Pty) Ltd and Michael Capela, in the court case in which the Association sought compliance with the RSDF. Sadly for Parkhurst residents, the case was lost.
This now has the effect that neither the Association, nor the residents of Parkhurst which the Association represents, can rely on the provisions of the RSDF to protect and preserve their suburb.
With the limited resources available to the Association, a generous "in full and final settlement" offer was made to both Hollyberry Props 3 (Pty) Ltd and Michael Capela. This offer was rejected. Hollyberry Props 3 (Pty) Ltd and Michael Capela will be taking further action against the Association.
The R150 000 costs order is way in excess of our available monies. Accordingly, the Association has no option but to dissolve.
